Subscription Terms & Conditions Before we start your wine deliveries, there are a few things we would like you to read and understand regarding your subscription plans. General Terms and Conditions for Subscription Contracts 1: Subscription contract: The contract for the regular supply of wine per the selected monthly subscription option (“the contract”) is concluded when an order is placed by the subscriber (“customer”) and confirmed by The Wine Monk Pte. Ltd (“the Company”) or based on a successful payment confirmation notification from Paypal. Commencement of delivery constitutes confirmation/acknowledgement by the customer of having signed up to the contract and to be bound by these terms and conditions and subjected to the minimum subscription period. 2: Term of the contract: All monthly wine subscriptions are for a period of 12 months paid in equal monthly instalment. Your subscription starts immediately after you subscribe. The first payment is deducted immediately if you subscribe online or when an invoice is sent and paid, and monthly going forward via automatic billing on the selected credit card/Paypal account. The minimum period for a subscription is 6 months. Cancellation is possible by giving the Company a cancellation notification three months in advance for Monk’s red-everyone’s envy and two months in advance for all other monthly subscriptions. For new customers, a cooling period of 2 weeks applies. The cooling period starts as soon as you subscribe. During this period, and before a delivery is completed as part of the monthly subscription, customer has the option to cancel the contract at no cost to the customer. Where a payment has been made, the Company will process the refund within 3-5 working days of the request. If the first delivery has been completed, the customer can still cancel the plan within 14 days for future orders. However, no refund or exchange will be made for the completed delivery. 3. Price Guarantee: All the subscription plans come with price guarantee. The price guarantee applies to scenarios where a subscriber is able to source the bottles locally at a cheaper price and excludes all overseas retailers/exporters. This means if you are able to buy the same bottles cheaper locally and get them delivered to your place at a price cheaper than your monthly subscription charges, we will refund you double the price difference. Please be aware merely the presence of a local entity listing the bottle at a price and sharing the details with The Wine Monk is not an assurance of price guarantee. Neither is from a local retailer who promises to deliver the bottles cheaper at a distant date in the future. The price guarantee applies to a customer being able to source the bottle at the same time as the subscription date accommodating for usual and reasonable delivery timelines. 4: Delivery Charges: All subscription plans enjoy free delivery Island wide excluding CBD where a surcharge of $10 applies for any delivery request. This $10 delivery charge is waived for all monthly subscriptions of $250 and above. Where a delivery fails due to unavailability of the customer to be available in the provided delivery slot, the Company will attempt to do another delivery on a best effort basis based on its own scheduling arrangements. In case of two consecutive failures for the same order or subsequent orders, the customer may be required to make his/her own arrangement to collect the wine from a designated location. 5. Legal drinking age of 18years: Before entering into the subscription plan, the customer must ensure he/she is of the legal drinking age. The customer must also ensure the recipient receiving the wine on his/her behalf (where applicable) is of legal drinking age. The Company or its authorized delivery agent, has the right to demand a valid proof of age if in doubt and, can refuse delivery where the company or its agent suspect the recipient is not of legal drinking age. Where a delivery fails because of the recipient not being of legal drinking age, this will be deemed the first delivery attempt. Any subsequent deliveries will be based on the Company’s scheduling arrangement. In case of two consecutive failures for the same order or subsequent orders, the customer may be required to make his/her own arrangement to collect the wine from a designated location. 6: Late or failed payment: The company may suspend deliveries in the event of late payment by the customer or failure of an auto debit by a payment gateway such as Stripe or Paypal or others as the case may be. Where a customer fails to adhere to the minimum subscription period and fails to compensate the company and take delivery of the wines, the company is within its right to disallow the customer from all future subscription programmes or refuse to service the customer for future wine orders. 7: Change of mailing/delivery address: A customer is duty bound to notify the Company of a change of mailing/delivery address at least 2 weeks in advance. Where a customer fails to notify the company and a delivery is made to the old address, for the fulfilment of this contract- the delivery would be deemed to have been successfully completed. It is the responsibility of the customer to then retrieve the delivery from the old address at his/her own cost. The customer will not have any claim for damages to the goods due to mismanagement of goods by the recipient at old address. 8: Force majeure: Interruptions in delivery In the case of force majeure (stoppages, government lock down, floods, shippers and forwarders going bankrupt, etc) and in the event of interrupted delivery due to circumstances beyond the company's control, the Company will not be liable for failure to deliver the wines within the promised delivery timelines. However, the company will make every effort to deliver the wines as soon as the normalcy resumes. 9: Liability of the company: The liability of the company is confined to willful intent and gross negligence and the subscriber would not have any claim beyond the advance payment made to the company and where delivery is pending against that advance payment. 10: Concluding provisions. As a customer, you agree that your personal details will be electronically processed and stored for the purpose of the contract and may be shared with an authorized delivery agent for fulfilment of your order. In the event of any dispute, the place of jurisdiction for both parties is Singapore.
